1. Introductory Provisions

1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) govern all contracts between the Seller and the Buyer for the sale of Tigé and ATX boats (hereinafter referred to as “boats”).

1.2 The Seller is Jacht servis s.r.o., with registered office at U Školky 464, 251 01 Nupaky, ID No.: 28452623, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 142566.

1.3 The term “Buyer” refers to any natural or legal person who agrees to these GTC and enters into a written contract with the Seller for the sale of the boat.

2. Order and Conclusion of the Contract

2.1 The Buyer may submit an order to the Seller in writing, electronically, or in person.

2.2 The order must include the boat’s name, exact specifications, quantity, required accessories, and any other Buyer preferences.

2.3 The Seller reserves the right to accept or reject the Buyer’s order. The contract between the Seller and the Buyer is concluded only after the Seller confirms the order in writing.

2.4 The contract for the sale of the boat is considered concluded when the Seller delivers the boat to the Buyer, and the Buyer pays the full purchase price.

3. Price and Payment Terms

3.1 The boat’s price is specified in the invoice or sales contract and is explicitly stated in the currency of payment.

3.2 The Buyer must pay the purchase price to the Seller within the period specified in the sales contract or invoice.

3.3 The Seller may request payment of the purchase price before delivering the boat to the Buyer if deemed necessary.

4. Delivery and Acceptance of the Boat

4.1 The Seller will deliver the boat to the Buyer according to the terms of the sales contract.

4.2 The Buyer must accept delivery of the boat at the agreed-upon time and place.

4.3 If the Buyer fails to accept delivery as agreed, the Seller is entitled to charge the Buyer for storage and care costs associated with the boat.

5. Warranty and Claims

5.1 The Seller provides warranties for the boats in accordance with the law. A new boat is warranted for a standard period of 5 years or 500 motor hours, unless otherwise specified.

5.2 Upon receipt, the Buyer must thoroughly inspect the boat and immediately report any apparent defects or deficiencies to the Seller.

5.3 If a defect is discovered after acceptance, the Buyer must notify the Seller immediately and within 7 days of discovery.

5.4 Any complaints regarding the boat must be made in writing and include a detailed description of the defect, along with photographs and other relevant information.

5.5 If a complaint is justified, the Buyer is entitled to have the defect rectified, the boat replaced, or receive a refund of the purchase price, as per the law.

6. Responsibility

6.1 The Seller is not liable for damages resulting from the Buyer’s improper use of the boat.

6.2 The Seller is not liable for damages incurred during the carriage of the boat, unless carriage is part of the sales contract and agreed upon with the Seller.

7. Privacy Policy

7.1 The Seller processes the Buyer’s personal data in accordance with applicable legislation and its own data protection policy, in compliance with GDPR.

8. Final Provisions

8.1 These GTC are an integral part of the contract for the sale of Tigé Boats and ATX Surf Boats between the Seller and the Buyer.

8.2 In the event of a dispute arising from the Boat Sales Contract, the parties will seek an amicable agreement. If no agreement is reached, the dispute shall be resolved by the competent court.
